The city council
The municipal council is an assembly that brings together the municipal councillors, elected by the population during municipal elections.
The municipal council, the deliberative body of the municipality, is responsible for municipal administration. It governs matters within the municipality's jurisdiction through its deliberations. Its operation is regulated by the municipal code, which also defines its powers and the division of responsibilities between the municipal assembly and its executive body, the mayor.
The council exercises its powers by adopting resolutions. It may form committees with the authority to conduct studies. The municipal council must meet at least once a quarter, and the agenda, set by the mayor, must be communicated before the start of the meeting. The meeting is open to the public unless the council decides to hold it behind closed doors or the mayor exercises their authority to maintain order during meetings, particularly in the event of disruption, and restricts public access to the proceedings.
It must elect the mayor and his deputies, vote on the municipal budget, organize and create municipal public services, and appoint representatives of the municipality to various organizations and institutions.
The functioning of the municipal council
The municipal council has general jurisdiction under common law to make decisions concerning the municipality: it governs the affairs of the municipality through its deliberations. It provides its opinion whenever required by specific laws or regulations, or at the request of the prefect. The municipal council also determines municipal employment.
The municipal council can only validly deliberate when a majority of its members are present. Decisions are made by an absolute majority of votes cast (half the votes plus one).
Minutes and deliberations
As a consequence of the elimination of the minutes of municipal council meetings, the meeting minutes have been, since July 1, 2022, the only official document by which the exchanges and decisions of local deliberative assemblies are transcribed and preserved.
The minutes of each meeting are drawn up by one of the secretaries, then they must be finalized, that is to say validated without any particular formality, at the beginning of the following meeting and then signed by the chairman and the secretary(ies).
The decisions made by the municipal council become enforceable as soon as they have been transmitted to the representative of theEtat and published.
